The short version
- Start with a free trial. No card is needed, and nothing is charged unless you add one.
- Plans renew monthly or yearly until you cancel. You can cancel in your account at any time, and the plan runs to the end of the period you have paid for.
- There is no commission on tickets. Ticket money goes to your own Stripe account, and you are the seller of your tickets.
- We give you at least 30 days’ notice of a price rise or a change to these terms that is not in your favour, and you can cancel before it applies.
1. The agreement
1.1 These terms are an agreement between Artefact Group Pty Ltd (ACN 661 296 715), trading as AdmitMe (“AdmitMe”, “we”, “us”), and the organisation that creates an account, starts a trial, chooses a plan or buys a service from us (“you”).
1.2 You accept these terms when you start a trial, add a payment method, choose a plan, buy lead scanning or accept a quote that refers to them. The person accepting confirms they are authorised to bind the organisation.
1.3 AdmitMe is a business service. You confirm you are using it for a business, community, government or other organisational purpose. If the Australian Consumer Law treats you as a consumer anyway, your consumer rights still apply.
1.4 The agreement is made up of these terms, the plan or price you choose on our pricing page or in your account, any written quote or order form, and our privacy policy. A signed quote or order form takes priority over these terms where they differ.
1.5 Hardware hire, purchase and leases are covered by our equipment terms. On-site event, production and consulting services delivered by Artefact Group are covered by the Artefact Group client services agreement referred to in the quote.
2. Your account
2.1 The person who creates the account is its owner. The owner can invite team members and control what they can do. You are responsible for what happens under your account, including by your team.
2.2 Keep sign-in details, API keys (including Scan and Sponsor keys) and device pairing codes secure. Tell us promptly through the support form if you think one has been misused.
2.3 Your plan sets how many organisers and events you can have. We may stop new events being created once a limit is reached; we will not remove existing events or tickets because of it.
3. Free trial
3.1 A trial lasts 28 days, or until the day after your first event if that is later, and never more than 90 days from the day it starts.
3.2 You do not need a card to start. A trial only becomes a paid plan if you add a payment method. If you have added one, your first payment is taken when the trial ends, for the plan and billing period you chose. We email you at least 3 days before the trial ends.
3.3 If the trial ends without a payment method, nothing is charged. Your account, events and data stay in place, but you cannot create new events until you choose a plan.
3.4 One trial per organisation. We may end a trial early if it is being used to get around these terms or in breach of them.
4. Plans and prices
4.1 Our plans, what they include and their prices are on the pricing page and in your account. You can pay monthly, or yearly at a lower monthly rate.
4.2 Plan prices exclude GST unless shown otherwise. Where GST applies, it is added to your invoice. Prices are charged in the currency you choose.
4.3 There is no commission and no per-ticket fee from AdmitMe on tickets you sell. Card processing fees are charged by Stripe to your own Stripe account (see clause 7).
4.4 Add-ons, such as lead scanning, custom domains, set-up help or hardware, are priced on our website, in your account or in a quote.
5. Billing and renewal
5.1 Plans are billed in advance. A monthly plan renews every month and a yearly plan renews every year, on the same date, until you cancel. We charge the payment method in your account at each renewal.
5.2 For a yearly plan, we email you at least 14 days before each renewal with the date and amount, and how to cancel.
5.3 Payments are processed by Stripe. Invoices and receipts are available in your account.
5.4 If a payment fails, we email you and retry it. If it still has not been paid 14 days after the due date, we may limit your account to read-only until it is paid, after telling you at least 3 days beforehand. We do not delete your data for late payment while the account is open.
5.5 If you change plan, the change takes effect straight away and the difference for the rest of the period is charged or credited to your account.
6. Cancelling
6.1 You can cancel at any time in your account under Billing, or by asking us through the support form. Cancelling is as easy as signing up, and we will not make you call us.
6.2 When you cancel, your plan stays active until the end of the period you have paid for, then stops. We do not charge you again.
6.3 Payments are not refunded for part of a period, except:
- where the law requires a refund;
- where you end the agreement because of our breach, or because of a change we make under clause 15, when we refund the unused part of any prepaid period; and
- if a yearly plan renews and you tell us within 14 days of the renewal date that you did not mean to renew, and you have not created an event or sold a ticket since that date, we refund the renewal in full.
6.4 After your plan stops, you can still sign in for 90 days to see and export your data. After that we may delete it, except records we must keep by law.
7. Selling tickets through AdmitMe
7.1 You are the seller. When you sell tickets through AdmitMe, you sell them to your ticket buyers in your own name. We provide the ticketing service and act as your agent to issue tickets and run check-in. Our ticket terms apply between your buyers and us, and you agree to them on your buyers’ behalf where relevant.
7.2 Payments. Ticket payments are processed through your own Stripe account, connected to AdmitMe. You must accept Stripe’s terms, including the Stripe Connected Account Agreement. Stripe charges its processing fees to you. Payouts are made by Stripe to your bank account on Stripe’s schedule.
7.3 Your obligations to buyers. You are responsible for your event and for complying with the law that applies to it and to your ticket sales, including that you:
- describe the event, ticket types and any conditions of entry accurately, and publish your refund policy before tickets go on sale;
- show the total price, including GST and every mandatory fee, before the buyer pays, and only apply a card surcharge that is no more than your cost of acceptance;
- never state or imply that buyers have no right to a refund where the Australian Consumer Law gives them one;
- refund buyers in full if you cancel the event, and offer a refund if you reschedule, relocate or materially change it, with a refund window of at least 7 days from when you tell them;
- tell buyers promptly about any change or cancellation (AdmitMe gives you tools to email every ticket holder);
- comply with ticket resale and anti-scalping laws in each state where your event is held, including any resale conditions that must be shown on the ticket and any declared-event rules;
- hold the licences, permits, insurance and approvals your event needs, and comply with the venue’s conditions; and
- handle complaints from your buyers, and remain responsible for your event and the money you receive for it.
7.4 Refunds you do not process. If you cancel an event and do not refund buyers within a reasonable time, or we receive a significant number of buyer complaints or disputes, we may pause sales, tell your buyers how to get a refund and process refunds from your Stripe balance on your behalf. We will tell you before we do this, unless doing so would harm buyers.
7.5 Chargebacks. Disputes, chargebacks and refunds on ticket payments are your responsibility, including Stripe’s dispute fees.
7.6 Pausing an event. We may pause sales for an event if we reasonably believe it is fraudulent, unlawful or unsafe, or is unlikely to go ahead, and we will tell you why.
8. Lead scanning for sponsors and exhibitors
8.1 Sponsors and exhibitors can buy lead scanning for an event. The prices are on the lead scanning page in each currency we offer. In Australia it is A$295 for the first device and A$145 for each extra device, including GST. Payment is taken by card when you buy.
8.2 Lead scanning lasts for the event you bought it for. The leads you capture belong to you, and you can export them from your account for at least 90 days after the event.
8.3 You must only use leads in line with the consent the attendee gave, the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth). That means you can only send marketing where the person has agreed to it, and every message must identify you and include a way to unsubscribe.
8.4 You get a full refund if the event is cancelled, or if you cancel before the event starts and no leads have been captured. Otherwise, lead scanning is not refunded for a change of mind, but your rights under the Australian Consumer Law still apply.
9. Acceptable use
You must not use AdmitMe to:
- sell tickets to an event that does not exist, will not be held as described, or that you are not authorised to sell;
- break any law, including consumer, privacy, spam, discrimination and ticket resale law;
- collect information from attendees that you do not need, or use it in a way they were not told about;
- send spam, malware or harmful content, or harass anyone;
- probe, overload, copy, resell or reverse engineer the platform, or get around its limits or security, except as the law permits; or
- infringe anyone’s intellectual property.
10. Your data
10.1 You own the content and data you put into AdmitMe, including your event details, branding and attendee data (“your data”). You give us permission to host, copy and process your data only to provide and support the service, and as our privacy policy describes.
10.2 For the personal information of your attendees, exhibitors and contractors, you decide what is collected and how it is used, and we handle it on your behalf. You must have a lawful basis and give the notices the Privacy Act 1988 (Cth) requires for what you collect.
10.3 We keep your data secure with reasonable technical and organisational measures. If we become aware of a data breach affecting your data, we will tell you without undue delay and work with you on any notification the law requires.
10.4 We may use aggregated, de-identified information about how AdmitMe is used to run and improve the service. It will not identify you or any person.
11. Our platform
11.1 We own AdmitMe, its software, designs and documentation, and everything we develop to improve it. While your plan is active, you may use AdmitMe for your organisation’s events. This agreement does not transfer any of our intellectual property to you.
11.2 If you give us suggestions or feedback, we may use them freely.
11.3 We may mention that you use AdmitMe, by name and logo, unless you ask us not to.
12. The service
12.1 We provide AdmitMe with due care and skill. We work to keep it available around the clock, but it may occasionally be unavailable for maintenance or because of problems outside our control. We schedule planned maintenance away from your events where we can.
12.2 We improve AdmitMe continuously and may change its features. We will not remove a core feature of your plan during a period you have paid for without giving you a pro-rata refund if you then cancel.
12.3 AdmitMe relies on services from others, such as Stripe, email providers and Apple and Google Wallet. Their terms may apply to how you use those features.
12.4 Support is by our support form, with replies on business days. Event-day support or a service level is available by agreement.
13. Liability
13.1 Nothing in this agreement excludes, restricts or modifies any right or remedy, or any guarantee, that cannot be excluded under the Australian Consumer Law or other law.
13.2 Where the law lets us limit our liability for a breach of a consumer guarantee, our liability is limited, at our choice, to supplying the services again or paying the cost of having them supplied again.
13.3 Otherwise, and to the extent the law allows, each party’s total liability under or in connection with this agreement is limited to the fees you paid us in the 12 months before the claim arose. Neither party is liable for loss of profit, revenue or data, or for indirect or consequential loss.
13.4 The limits in 13.3 do not apply to your obligation to pay fees, to either party’s liability for fraud, wilful misconduct, personal injury or death, or to your liability under clause 13.5.
13.5 You are responsible for, and will cover us against, claims by your ticket buyers, attendees or others arising from your event, your content or data, or your breach of clause 7 or 9, except to the extent the claim was caused by us.
13.6 Each party’s liability is reduced to the extent the other party caused or contributed to the loss.
14. Suspension and ending the agreement
14.1 You can end the agreement at any time by cancelling under clause 6.
14.2 Either party may end the agreement by written notice if the other materially breaches it and does not fix the breach within 14 days of being asked to, or becomes insolvent.
14.3 We may suspend your account straight away, telling you why, if we reasonably believe it is being used fraudulently or unlawfully, or puts the security of AdmitMe, other customers or ticket buyers at risk. We will restore it once the issue is resolved.
14.4 If we stop offering AdmitMe, we will give you at least 90 days’ notice and refund any prepaid fees for the period after the service ends.
14.5 Clauses 6.4, 7.4, 7.5, 10, 11, 13 and 16 survive the end of the agreement.
15. Changes to prices and these terms
15.1 We may change our prices or these terms. If a change is not in your favour, we will email the account owner at least 30 days before it applies to you. A price change applies from your next renewal after the notice period.
15.2 If you do not agree to a change, you can cancel before it applies. If the change takes effect during a period you have prepaid, we refund the unused part of that period.
15.3 Changes that are in your favour, or that the law requires, can take effect straight away.
16. General
16.1 Disputes. If a dispute arises, either party may give the other written notice of it, and senior people from each side will try in good faith to resolve it within 20 business days. If that does not work, either party may refer it to mediation in Brisbane, or go to court. Nothing stops a party seeking urgent relief.
16.2 Events outside our control. Neither party is responsible for a delay or failure caused by events outside its reasonable control, other than paying money owed.
16.3 Transfer. You may transfer this agreement with our written consent, which we will not unreasonably refuse. We may transfer it to a related body corporate, or to a buyer of the AdmitMe business, on written notice to you, provided your rights under it are not reduced.
16.4 Notices. We send notices to the account owner’s email address. You can send notices through the support form or contact form.
16.5 Law. This agreement is governed by the laws of Queensland, and the parties submit to the courts of Queensland.
16.6 If part of this agreement is unenforceable, it is read down or severed and the rest continues. Not enforcing a right is not a waiver of it. This agreement is the whole agreement about its subject matter.
